These Terms and Conditions (“Terms”) govern all sales and deliveries of products, digital content, courses, training services, consultancy services, and subscription-based services provided by E.R.T Nordic AS (“E.R.T Nordic AS”, “we”, “us”, “our”) to consumers and business customers.
By placing an order, subscribing, or otherwise engaging our services, you agree to be bound by these Terms.
1. Scope and Applicability
These Terms apply to:
- Physical products
- Digital products and online courses
- Training programs and workshops
- Consultancy and advisory services
- Subscriptions and recurring payment services
Certain products or services may be subject to additional product- or service-specific terms, including manufacturer warranties, usage limitations, or safety instructions. Such terms apply only to the relevant product or service and do not replace these Terms, except where required by mandatory law.
2. Contract Formation
A binding agreement is concluded when:
- The customer places an order via our website, written agreement, or other approved channel, and
- The order is confirmed by E.R.T Nordic AS in writing (including email confirmation).
3. Prices, Taxes, and Payment
- All prices are stated in NOK, unless otherwise specified.
- VAT is included where applicable.
- Payment terms, billing intervals, and accepted payment methods are disclosed prior to purchase.
- Subscriptions and fixed payments are charged in advance unless otherwise agreed in writing.
4. Subscriptions, Fixed Payment, and Binding Period
4.1 Subscription Types
Subscriptions may be offered as:
- Ongoing subscriptions with recurring payments, or
- Subscriptions with a defined binding period, as clearly stated before purchase.
4.2 Binding Period
If a binding period applies:
- The minimum duration will be clearly disclosed prior to contract conclusion.
- Termination during the binding period may result in continued payment obligation for the remaining period, unless otherwise required by law.
5. Termination and Cancellation
5.1 Ordinary Termination
Subscriptions without a binding period may be terminated with 30 days written notice, effective at the end of the current billing cycle.
5.2 Early Termination
Early termination during a binding period is subject to the agreed payment obligations, unless mandatory law provides otherwise.
6. Right of Withdrawal (Consumers Only)
Consumers have a 14-day right of withdrawal under the Norwegian Right of Withdrawal Act (Angrerettloven).
Exceptions apply for:
- Digital content delivered immediately with consumer consent
- Services fully performed within the withdrawal period after consent
7. Products Manufactured by Third Parties (Including Fire Isolator Products)
E.R.T Nordic AS distributes certain products manufactured by third parties, including Fire Isolator BV.
7.1 Product-Specific Terms
Such products are supplied with manufacturer-specific terms, including:
- Intended use and limitations
- Safety instructions
- Warranty conditions
These manufacturer terms form part of the agreement for the relevant product only.
7.2 Fire Isolator Products
Fire Isolator products are designed for specific fire containment and isolation use cases, as defined by the manufacturer.
Misuse, modification, or use outside intended scope may void manufacturer warranty coverage.
Nothing in manufacturer terms limits statutory consumer rights under Norwegian law.
8. Warranty and Complaints
8.1 Manufacturer Warranties
Manufacturer warranties apply in accordance with their respective terms.
8.2 Statutory Rights
Consumers retain all mandatory rights under the Norwegian Consumer Purchases Act (Forbrukerkjøpsloven), including rights related to defects, remedies, and complaints.
Where manufacturer warranties are more restrictive, statutory rights shall prevail.
9. Delivery
- Physical products are delivered according to stated delivery times.
- Digital products and courses are delivered electronically.
- Consultancy and training services are delivered as agreed in writing.
10. Proper Use and Safety
Products and services must be used strictly in accordance with:
- Supplied instructions
- Training materials
- Applicable safety standards and regulations
Products intended for emergency preparedness, fire containment, or operational use may pose serious risk if misused.
E.R.T Nordic AS is not responsible for damage or injury resulting from improper use, modification, or failure to follow instructions.
11. Courses, Training, and Educational Content
- Courses and training are provided for educational and professional development purposes.
- Completion of training does not constitute certification, authorization, or regulatory approval unless explicitly stated in writing.
- Customers are responsible for ensuring suitability and regulatory compliance.
12. Limitation of Liability
To the maximum extent permitted by Norwegian law:
- E.R.T Nordic AS shall not be liable for indirect or consequential loss.
- Liability for third-party manufactured products is limited to what is permitted under Norwegian law and applicable manufacturer warranties.
Nothing in these Terms limits liability for:
- Personal injury
- Gross negligence or willful misconduct
- Mandatory statutory consumer protections
13. Force Majeure
E.R.T Nordic AS shall not be liable for failure or delay in performance due to events beyond reasonable control, including natural disasters, regulatory changes, labor disputes, supply chain disruptions, or technical failures.
14. Changes to Terms
E.R.T Nordic AS reserves the right to update or modify these Terms.
Material changes will be notified in advance where required by law.
15. Governing Law and Dispute Resolution
These Terms are governed by Norwegian law.
Consumers may bring disputes before:
- The Norwegian Consumer Council (Forbrukerrådet), or
- The competent Norwegian courts.
